The Problem

During an investigation, a traffic accident, or a minor dispute, a police officer takes your physical passport and tells you that they will keep it "for now." You are left without your primary document, feeling trapped and unable to move freely.

How the Law Works in Turkey

Police officers can temporarily hold your passport to record your details or verify your legal status in the system. However, unless you are officially under arrest or a judge has issued a formal "Travel Ban" (Yurtdışı Çıkış Yasağı), the police cannot permanently seize your passport. It is the property of your home government.

What the Tourist Should Do

Always ask why the passport is being held and request a "Receipt/Seizure Report" (El Koyma Tutanağı). This is a legal document proving the police have your passport. If they do not return it within a reasonable time (e.g., after the statement is taken), politely ask for the officer’s name and badge number and contact your embassy immediately.

The Risks

If the police take your passport and do not provide an official report, you are in a legal "grey area." You cannot check into a hotel, board a domestic flight, or leave the country. If the passport is lost while in police custody without a report, proving it was with the authorities becomes incredibly difficult.
